Politics, livelihood top concerns for public
(The Standard P.5 26 June 2013) Politics is the one facet (方面) of our community
life that troubles the public the most, ahead of even the economy and
livelihood issues.
That is the conclusion of the latest
University of Hong Kong poll.
It found the levels of public satisfaction to
be all negative in the three areas, minus (負數) nine for the economy, minus 28 in
livelihood and minus 43 for the political situation.
Only 13.3 percent were satisfied with the
political situation, the lowest since 2004.
The HKU Public Opinion Programme poll took in
1,040 people between June 13 and 19.
The findings on the three fronts (政治, 經濟等的)方面 are not much
different from those of half a year ago.
"People are still least
(最少的) satisfied with the current political condition," said program director
Robert Chung Ting-yiu.
"An in-depth
(全面地) analysis shows that the younger the respondents, the more dissatisfied they are
with the current livelihood condition."
Meanwhile, a snap
poll by The Standard of 20 people showed they were split over the first-year
performance of Chief Executive Leung Chun-ying.
Leung has said
economic development, housing, poverty, the elderly and environmental
protection are the five core policy areas for his administration.
Most of those born in
the 1950s to 1960s gave him a thumbs-up.
He did poorly in all
five areas for those born in the 1980s and 1990s.
Most were
dissatisfied with housing, saying it is hard for the young to get a decent (像樣的)
flat.
Kenny Chu Man-kit, a
20-year-old student, said he failed to see concrete (具體的) work done to improve
poverty.
Most said Leung has
failed to improve the economy.
But teacher Siu
Shuk-hing, 40, said the government needs more time.
"It is not
Leung's fault. The problem has existed since Donald Tsang Yam-kuen's
administration," he said. "Leung needs time to remedy."

買沙灘好易賺？
氹買內地沙灘 6000萬倒落海
【太陽報專訊】買沙灘好易賺？港府出招打擊炒樓，港人另找其他投資渠道，有自稱內地房地產開發公司最近向港人招商到內地投資，聲稱合作發展惠東縣一幅連沙灘的海邊土地，興建酒店及度假式住宅，港人投資六千萬元人民幣，數年間回本且獲得可觀利潤。本報記者接觸有關發展商負責人，對方不但未能提供在內地發展項目所需的土地證及建設證，最令人奇怪的是，被指賣地的村民竟對事件全不知情，惠東縣國土資源局更直指，該幅海邊土地屬政府所有，不能私下買賣及發展，港人以巨額投資，隨時「得個吉」！
「海邊土地合作，靚沙灘」，一則在本港報章刊登的廣告，招攬港人在惠東合作發展一幅面積達十八萬平方米的臨海土地，更標明土地包括一個「靚沙灘」。記者日前以投資者身份致電查詢，隨即被一名自稱姓李男子相約到深圳一間酒家傾談「發展大計」。
村民：浪大唔適合發展
「坐低慢慢睇啲資料。」自稱是內地房地產開發公司負責人的李先生，當日與太太和兩名內地女子一同赴會，甫見到記者便「你一言、我一語」，叫記者詳閱他們帶來的資料，包括公司營業執照、海邊土地的坐標測繪圖，以及一份與原持有土地村民代表簽署的項目發展合約：「我哋合作，你出錢，我出地，一齊搞好個沙灘！」
李表示，他的房地產開發公司於一○年成立，翌年便與惠東一條漁村的村民小組簽署項目發展合約，以一百萬元人民幣承包土地費用，合約訂明該公司擁有該漁村一幅十八萬平方米臨海土地的唯一經營使用權：「到時賺到錢就你七我三，幾年就有錢賺！」李介紹，總面積達十八萬平方米的土地，山地佔十六萬平方米，沙灘則佔兩萬平方米。他滔滔不絕講解「發展大計」，更強調有「全盤計劃」，土地共分三期發展，分期興建酒店式公寓、酒店和度假式住宅。
眼見記者狀甚疑惑，他大落嘴頭指「一定賺o架」，又指三期投資只需第一期要注資：「你畀咗第一期六千萬先，起好之後賣咗佢，賺咗第一桶金再起第二期、第三期，唔使再攞錢。」但當記者查問該土地是否已有發展房地產項目所需的土地證及建設證時，他含糊其詞地說：「政府嗰邊啲證好易搞o架，有錢就搞得掂。」
由於對方未能出示有關證明，記者直接到該漁村找村民了解事件，竟換來「無人賣地」的答案：「這條小村，哪有甚麼村民小組，都是自己住的。」在該漁村土生土長的小王（化名）稱，村內僅二、三十戶，並沒有村長和村委會等負責處理村內事務，更從未聽過有村民小組和公司簽署合約一事。
小王隨後帶記者經小路走到海邊，到達廣告提及的「靚沙灘」：「這個灘浪大，不適合發展的，有時海水更會淹到上來。」另一位在海邊做了八年鮑魚養殖的村民羅先生指，該沙灘平時沒有人來，亦未有人來過視察或表示要發展沙灘：「你看，一個浪打過來，海裏的垃圾都上來了。」
「這地不可能被買賣和發展，地是政府的，那樣做會違法呀。」記者隨後到惠東縣國土資源局查證，當局一名信息中心職員用電腦搜索「被出售土地」的坐標測繪圖，直指有關土地及沙灘不准買賣。他稱，政府約於○七年跟數個地產商簽署合約，把有關山地跟沙灘列為一個發展項目的後備用地，政府有權隨時徵用：「村民用是可以啦，在上面種種東西，但如果賣給別人就有問題了。」
律師：隨時遭民事起訴
「你唔係投資問嚟都冇用。」記者隨後表明身份致電向李查詢，對方仍堅持只要有足夠資金，「大計」便可實行，對於記者指惠東縣國土資源局職員指土地為政府所有，不能被買賣或用作發展，對方只不斷推說「有錢就搞得掂」，更囑記者「唔係投資就唔好再問」，便匆匆掛線。
中原地產大陸區總裁賴國強直指，該份和村民簽署的項目發展合同條文「好有問題」：「政府准村民用塊地，唔等於村民可以私底下簽署買賣合同，份合同好有可能無效。」內地律師陳志榮亦表示，村民擅自將政府土地進行買賣，除合約沒有效力之外，買賣雙方也可能被民事起訴，隨時「一身蟻」。陳建議港人如欲在內地投資發展房地產，必先留意發展商是否已辦妥所有政府批文，屬「可投資」土地，方為上策。

醫療集團蠱惑假自僱
勞聯質疑有大型醫療集團要求護理人員「假自僱」。
【太陽報專訊】「假自僱」是部分無良僱主逃避對員工應有責任的方式，勞工處去年接獲十三宗有關投訴，個案較前年激增兩倍。有工會最近發現，有大型醫療護理集團竟化身為「職業介紹所」，要求護理人員簽署列明屬自僱的合約，但在工作上作出種種約束，包括「不可取消已預約工作、不可私自改更期，不可直接致電顧客」，工會指護理人員處處受制於公司，質疑屬「假自僱」。
港九勞工社團聯會最近發現，一家大型醫療護理集團要求護理人員簽署的同意書上，列明集團為職業介紹所，護理人員在集團的名單上登記便可獲介紹工作，並不構成僱主及僱員關係，但集團向護理人員發出的工作須知，卻列出多項規條，包括上班需穿着集團的制服、不可穿短褲及塗香水，全職者需提早三天告假等；護理人員亦不可取消已預約工作、不可私自改更期或找人替更、更需早十分鐘到達工作地點，如違反規定需逐項向集團支付二百元行政費用，護理人員未得批准私自接受客戶聘用，需向集團賠償三萬元。自僱應有自主權
勞工處指，法庭在考慮某人士屬僱員或自僱人士時，會考慮雙方在定約時的共同意願、「自僱者」對接受所委派工作的自主權、「僱主」對「自僱者」的工作控制權、「自僱者」是否自聘所需幫工、是否自備工作所需器材等。
勞工處於一○至一二年共接獲二十三宗假自僱投訴，主要涉及運輸、個人服務及建造業。
勞聯幹事曾小芳指，自僱人士有工作自主權，但該集團的護理人員卻需按公司要求上班，「好多事都鎖死晒」，質疑屬假自僱。
但該集團負責人則否認指控，指有關約束屬行規，又稱「好多人唔鍾意受聘，如佢哋肯，我哋都可以請」。負責人又指出，如護理人員取消預約或遲到，公司需要安排另一人「頂上」，故需收行政費。

Accepting restaurant gifts worth HK$5,000 has cost a senior cop his freedom, his job and up to HK$6 million in pension.
Titus Wong Koon-ho was earning HK$80,000 a month as a Wan Chai superintendent after 27 years in the police.A flood of letters supporting 51-year- old Wong failed to move magistrate Adriana Tse Ching, who said she had never before come across such poor evidence as that offered by Wong."Even 1,000 letters would be useless," Tse said in Eastern Magistrates' Court.Wong was convicted of misconduct in public office by receiving HK$5,000 in gifts and discounts from a restaurant for turning a blind eye to its liquor license violations. In jailing Wong for a year, Tse condemned him for blatantly violating the law by inviting his subordinates at the Liquor Licensing Board to dine at the restaurant, ignoring that it was selling spirits without a license. She said Wong put his subordinates "into a position of a conflict of interest."She called the case very serious, especially as Wong did not show remorse and his evidence was full of lies. "I have not come across such poor evidence since I became a magistrate," she said. Tse rejected a bail application pending an appeal. In his plea, barrister Albert Luk Wai- hung submitted 60 letters of mitigation from people, including the assistant commissioner of police, the central government liaison office and the US consulate-general. Wong's divorced wife also praised him as a good father.But the
magistrate said Wong should have learned from the case of senior superintendent Sin Kam-wah, who was found guilty of misconduct by receiving free sex from prostitutes. "If there is no strong reason for mitigation, even a thousand letters would be useless," she said. Luk also asked the magistrate to consider Wong a person of good conduct who served the community for years, especially as the case did not involve a large amount of money.Wong had lost his police job and would lose his pension.But Tse said it was trouble of his own making. "Police officers do not serve society for free. They are well paid for it," the magistrate said.The court heard that Wong and his colleagues dined on three occasions at Chen Teen Bistro between June and early August in 2011 and were given discounts each time. These included a HK$2,200 meal, for which Wong paid only HK$300.He was also given a HK$1,000 bottle of whisky while dining in the VIP room of before the restaurant was allowed to serve alcohol. Luk said outside court that Wong would appeal and may apply to the High Court for bail.Wong joined the force in 1986. Eric Tung Yiu-ming, spokesman for the Junior Police Officers' Association, guessed Wong would lose his pension of HK$5 million to HK$6 million.A police spokesman said the force has zero tolerance for corruption and illegal activity, and Wong's case was an isolated incident.The Civil Service Bureau said authorities study court records and details of cases and consider disciplinary action if a civil servant is convicted of a criminal offense.
